1. The Service

TosSend is an email infrastructure platform for developers. It provides transactional and marketing email sending, MJML template rendering, real-time delivery analytics (opens, clicks, bounces, complaints), DKIM/SPF/DMARC authentication, managed IPs, blocklist monitoring, automatic IP warm-up, REST API access, webhooks, and contact management. The platform is currently in Early Access.

2. Account Registration

You must register an account to use the Service. You agree to provide accurate information and keep it current. You are responsible for maintaining the confidentiality of your API keys and credentials and for all activity that occurs under your account.

No credit card is required for the free plan. You may access the platform with full API access from day one of registration.

3. Free Plan

During Early Access, TosSend offers a free plan that includes up to 100 emails per day. This limit may change with notice as the platform scales. Free plan resources are provided as-is, without guaranteed uptime SLAs.

4. Acceptable Use

You agree not to use the Service to:

• Send unsolicited bulk email (spam) or email to recipients who have not opted in
• Distribute malware, phishing content, or any malicious code
• Send content that violates applicable law, including laws on privacy, intellectual property, or consumer protection
• Abuse platform resources in a way that degrades service for other users
• Attempt to reverse-engineer, probe, or compromise the security of the platform
• Impersonate another person, organization, or brand without authorization

We reserve the right to suspend or terminate accounts that violate this policy without prior notice.

5. API Use

The TosSend API is available via the tossend npm package and compatible with Node.js, Python, Go, and PHP environments. You are responsible for keeping your API keys confidential. API rate limits and sending quotas apply per plan. Do not share API keys in public repositories or client-side code.

6. Intellectual Property

TosSend and its underlying technology are owned by us and protected by applicable intellectual property law. You retain ownership of the email content, templates, and contact data you bring to the platform. You grant us a limited license to process that data solely to deliver the Service.

The TosSend name, logo, and associated marks are our trademarks. You may not use them without our prior written permission.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TOSSEND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Changes to the Service and Terms

We may modify these Terms or the features of the Service at any time. When we make material changes, we will notify you by updating the "Last updated" date and, where appropriate, by email. Continued use of the Service after changes take effect constitutes your acceptance.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your account for violation of these Terms or for any other reason with reasonable notice, except where immediate action is required to protect the platform or other users.
